Agreement Between User and Camp Margaritaville Resort Orange Lake
Welcome to Camp Margaritaville Resort Orange Lake ("Resort," "Camp Margaritaville," "we," "our," or "us"). By making a reservation, accessing our property, utilizing our amenities, visiting the Resort, or using our website, you agree to be bound by these Terms and Conditions, as well as all applicable Resort policies, rules, regulations, and procedures.
If you do not agree with these Terms and Conditions, you should not make a reservation or access the Resort.
Modifications to These Terms
Camp Margaritaville Resort Orange Lake ("Resort," "we," "our," or "us") reserves the right to revise, modify, update, or replace these Terms at any time without prior notice.
Any modifications become effective when posted to the Resort website.
Continued use of the Services following any change constitutes acceptance of the revised Terms.
1. Reservations
Reservations are subject to availability and are not guaranteed until confirmed by the Resort.
The Resort reserves the right to refuse, deny, modify, or cancel any reservation at its sole discretion where permitted by law, including but not limited to circumstances involving payment issues, policy violations, occupancy restrictions, safety concerns, or operational requirements.
Guests must be at least twenty-one (21) years of age to reserve and occupy a campsite, cabin, or accommodation unless otherwise permitted by the Resort.
The individual making the reservation must be present during the stay and is responsible for all occupants and visitors associated with the reservation.
2. Rates, Fees, and Taxes
All rates are quoted in U.S. dollars and are subject to applicable taxes, governmental fees, resort fees, utility charges, and other charges as required by law or Resort policy.
Rates, promotions, discounts, and package offerings are subject to change without notice and may be modified, discontinued, or restricted at any time.
The Resort reserves the right to correct pricing errors, inaccuracies, or omissions.
Additional fees may apply for:
- Additional guests
- Pets
- Golf carts
- Vehicle registrations
- Special events
- Premium site selections
- Damages or excessive cleaning
- Late departures
- Returned payments
3. Deposits and Payment
Payment requirements will be disclosed during the reservation process.
The Resort may require a deposit, advance payment, or full payment at the time of booking.
Guests authorize the Resort to charge the payment method on file for:
- Outstanding balances
- Resort fees
- Damage charges
- Cleaning fees
- Policy violations
- Unpaid purchases
- Utility charges
- Any authorized fees incurred during the stay
Failure to provide valid payment information may result in cancellation of the reservation.
4. Cancellation and Refund Policy
Cancellation policies vary based on accommodation type, season, rate plan, and promotional offer.
Unless otherwise specified at the time of booking:
- Cancellations must be made before the applicable cancellation deadline.
- Refund eligibility is determined according to the reservation's specific rate terms.
- No-shows may forfeit all deposits and payments.
- Early departures may not qualify for refunds.
- Weather-related cancellations may be handled according to the applicable reservation policy.
The Resort reserves the right to cancel reservations due to emergency situations, natural disasters, government actions, safety concerns, maintenance needs, force majeure events, or circumstances beyond the Resort's control.
5. Check-In and Check-Out
Guests must comply with all published check-in and check-out procedures.
Government-issued photo identification may be required at check-in.
The Resort reserves the right to deny access to individuals who are unable to verify their identity or reservation information.
Early check-in and late check-out requests are subject to availability and may incur additional fees.
Guests remaining beyond approved checkout times may be charged additional fees.
6. Occupancy and Visitors
Occupancy limits are established for each campsite, cabin, and accommodation type.
Guests may not exceed maximum occupancy limits.
Visitors may be required to register upon arrival and may be subject to fees, access restrictions, and occupancy limitations.
The registered guest assumes responsibility for the conduct of all visitors.
The Resort reserves the right to restrict, remove, or deny access to any visitor at any time.
7. Resort Rules and Guest Conduct
All guests and visitors must comply with Resort Rules and Regulations, which are incorporated into these Terms and Conditions by reference.
Guests agree to conduct themselves in a respectful and lawful manner.
The following may result in immediate removal from the Resort without refund:
- Disorderly conduct
- Harassment of guests or employees
- Excessive noise
- Threatening behavior
- Illegal activity
- Property damage
- Repeated policy violations
- Unsafe conduct
The Resort reserves the right to involve law enforcement when deemed necessary.
8. RV Sites and Camping Requirements
Guests occupying RV sites must utilize equipment that meets Resort requirements and all applicable laws and regulations.
The Resort may restrict RVs based on age, appearance, condition, size, safety, or operational concerns.
Site assignments are not guaranteed.
The Resort reserves the right to relocate guests to comparable accommodations or campsites as operational needs require.
Guests are responsible for proper hookup, operation, and maintenance of their equipment.
Utility interruptions caused by weather, maintenance, third-party providers, or unforeseen events shall not create liability for the Resort.
9. Pet Policy
Pets are welcome only in designated areas and accommodations.
Guests bringing pets agree to:
- Maintain control of pets at all times
- Use leashes where required
- Clean up after pets immediately
- Prevent excessive noise or disturbances
- Ensure pets do not create safety risks
Aggressive, disruptive, or uncontrolled animals may be removed from the Resort.
Pet owners are solely responsible for injuries, damage, claims, costs, or liabilities caused by their pets.
Service animals will be accommodated in accordance with applicable law.
10. Vehicles and Golf Carts
Guests must comply with all posted traffic rules and speed limits.
Only properly licensed and insured vehicles may be operated on Resort property unless otherwise permitted.
Golf carts may be subject to separate registration requirements, operational rules, insurance requirements, and age restrictions.
The Resort reserves the right to prohibit operation of any vehicle deemed unsafe.
Guests assume all risks associated with vehicle operation on Resort property.
11. Resort Amenities and Activities
The Resort may provide recreational facilities, pools, playgrounds, events, food and beverage venues, entertainment offerings, sports courts, dog parks, and other amenities.
Amenities:
- Are subject to operating hours
- May require reservations
- May have age restrictions
- May have separate rules
- May be unavailable due to maintenance, weather, staffing, private events, or safety concerns
Availability of amenities is not guaranteed and shall not entitle guests to refunds, credits, or compensation.
Participation in activities is voluntary and undertaken at each guest's own risk.
12. Assumption of Risk
Guests understand that camping, RV travel, outdoor recreation, swimming, sports, walking, biking, playground use, wildlife encounters, and participation in recreational activities involve inherent risks.
By entering Resort property, guests voluntarily assume all risks associated with:
- Outdoor activities
- Recreational amenities
- Natural terrain
- Weather events
- Wildlife
- Water features
- Vehicle traffic
- Physical activity
Guests are responsible for evaluating their own abilities and supervising minors at all times.
13. Release and Limitation of Liability
To the fullest extent permitted by applicable law, the Resort, its affiliates, owners, officers, employees, contractors, agents, and representatives shall not be liable for:
- Personal injury
- Property damage
- Theft
- Loss of personal property
- Utility interruptions
- Service disruptions
- Weather-related impacts
- Accidents occurring on the property
- Missed reservations due to circumstances beyond Resort control
Guests assume responsibility for securing their personal property at all times.
I hereby release and hold harmless, waive, discharge and covenant not to sue the Resort, Island Hospitality and their affiliates, officers, servants, agents, or employees from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the releasees or otherwise, while staying at the Hotel, or while in, on or upon the premises of the Hotel and/or the surrounding area.
I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of staying at the Hotel, whether caused by the negligence of releasees or otherwise.
I further agree to indemnify and hold harmless the releasees from any loss, liability, damage or costs, including court cost and attorney fees, that they may incur, whether caused by negligence of releasees or otherwise.
It is my express intent that this release shall bind the members of my family and spouse, if I am alive, and my heir’s assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue the above named releasees. I further agree that this waiver of liability shall be construed in accordance with the laws of the state in which the Hotel is located.
In signing this release, I acknowledge and represent that I have read the above release and understand it and sign it voluntarily as my own free act and deed; no oral presentations, statements, or inducements, apart from the foregoing written agreement, have been made. I accept full responsibility for the cost of treatment for any injury. I also understand and agree that I may be held liable for any damage or loss to that is caused by my own negligence, gross negligence, willful misconduct or fraud. I understand that any activity of this nature involves a level of risk.
I am at least eighteen (18) years of age and fully competent; and by signing this document, I execute this release for full, adequate, and complete consideration fully intending to be bound by same.
Nothing in these Terms shall be interpreted to limit liability where such limitation is prohibited by law.
14. Property Damage
Guests are responsible for any damage caused by themselves, occupants, visitors, pets, vehicles, equipment, or personal property.
The Resort may charge the payment method on file for:
- Repair costs
- Replacement costs
- Cleanup expenses
- Restoration expenses
- Lost revenue resulting from damage
Guests remain responsible for all damages exceeding collected amounts.
15. Indemnification
Guests agree to defend, indemnify, and hold harmless the Resort and its affiliates from any claims, damages, liabilities, losses, costs, expenses, or legal fees arising from:
- Guest actions
- Policy violations
- Negligence
- Damage to property
- Injury to persons
- Pet-related incidents
- Visitor conduct
16. Photography, Video, and Marketing
The Resort may photograph, film, or record activities occurring in public areas for operational, security, promotional, marketing, and training purposes.
By entering the Resort, guests acknowledge that they may appear in photographs or video recordings captured in public areas.
Additionally, guests who voluntarily post photographs, videos, or other content depicting the Resort on social media and tag, mention, check in at, or otherwise identify the Resort grant the Resort a non-exclusive, royalty-free permission to repost, share, display, and use such content on the Resort's social media channels, website, and other marketing materials, unless the guest notifies the Resort in writing that they do not consent to such use.
Guests who do not wish to appear in promotional materials or have their tagged social media content used by the Resort should notify Resort management in writing.
17. Internet and Technology Services
Wireless internet access may be provided as a convenience.
The Resort does not guarantee:
- Internet speed
- Reliability
- Availability
- Network security
Guests use internet services at their own risk and are responsible for securing their devices and personal information.
18. Privacy
The collection, use, storage, and protection of personal information are governed by the Resort's Privacy Policy.
By providing personal information, guests consent to the Resort's collection and use of such information in accordance with the Privacy Policy.
19. Force Majeure
The Resort shall not be liable for delays, interruptions, closures, cancellations, or inability to perform obligations resulting from events beyond its reasonable control, including:
- Hurricanes
- Flooding
- Fire
- Severe weather
- Epidemics
- Government actions
- Labor disputes
- Utility disruptions
- Natural disasters
- Acts of God
20. Website Use
All content available on the Resort's website, including logos, trademarks, images, text, graphics, and other materials, is the property of the Resort or its licensors and may not be used without authorization.
Users may not:
- Misuse the website
- Attempt unauthorized access
- Interfere with website operations
- Transmit malicious software
- Violate applicable laws while using the website
21. SMS Privacy Policy
We will not share or sell subscriber information with third parties for their direct marketing purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. 22. Governing Law and Venue
These Terms and Conditions shall be governed by the laws of the State of Florida without regard to conflict of law principles.
Any dispute arising from or relating to these Terms, the Resort, or a guest's stay shall be resolved exclusively in the appropriate state or federal courts located in Florida, unless otherwise required by law.
23. Modifications to Terms
The Resort reserves the right to update, modify, revise, or replace these Terms and Conditions at any time.
Updated versions will be posted on the Resort's website and become effective upon posting unless otherwise indicated.
Continued use of the Resort following any update constitutes acceptance of the revised Terms.
