Our resort speed limit is 15 MPH, and all electric or motorized devices must follow posted traffic rules and designated riding areas. These guidelines help keep our roads safe, protect pedestrians, and preserve the laid-back island vibe for everyone.
Golf Cart Rental Agreement, Waiver, Release and Assumption of Risk
Prior to operating a golf cart at Camp Margaritaville Auburndale, all renters must review and accept the Golf Cart Rental Agreement, Liability Waiver, Assumption of Risk, and Indemnification Agreement. By completing the rental process, the renter acknowledges responsibility for the safe operation of the golf cart and agrees to the terms and conditions established by Camp Margaritaville Auburndale, its ownership, management, employees, affiliates, and representatives.
Eligible Operators
Renter represents and warrants that:
- Operator is at least 18 years of age
- Operator possesses a valid driver’s license
- Operator is physically and mentally capable of safely operating a golf cart
- Operator will comply with all Resort rules and Florida law
Acknowledgment of Risks
Renter understands that golf cart operation involves inherent and significant risks that may result in:
- Serious bodily injury
- Paralysis
- Death
- Collision injuries
- Rollover accidents
- Property damage
- Or loss
Risks include, but are not limited to:
- Collisions with vehicles, structures, pedestrians, bicycles, or other golf carts
- Uneven terrain
- Wet pavement
- Poor visibility
- Weather conditions
- Sudden stops or turns
- Excessive speed
- Distracted driving
- Inexperienced operators
- Nighttime operations
- Mechanical failure
- Acts of other guests
- Operation by minors
- Alcohol or drug impairment
Renter voluntarily assumes all risks associated with golf cart operation and occupancy.
Florida Camping Liability Notice
Pursuant to Florida Statute 513.201
WARNING
Under Florida law, a private campground owner, operator, or employee is not liable for a person's injury or death, or any damage to or loss of such person's property, who is camping at a private campground if such injury, death, damage, or loss results from the inherent risk of camping. The inherent risk of camping includes, but is not limited to, risk of injury, death, damage, or loss inherent to land, equipment, weather, animals, and actions by other persons, as well as the potential for you to act in a negligent manner that may contribute to your own injury or death or the damage to or loss of your own property.
YOU ARE CAMPING AT YOUR OWN RISK.
Renter acknowledges that golf cart operation is part of the camping and resort experience and may involve inherent risks associated with outdoor recreation and campground activities.
Golf Cart Operation Rules
Renter agrees:
- No reckless driving
- No racing or horseplay
- No operation while impaired by alcohol or drugs
- No texting or distracted driving
- All passengers must remain seated while vehicle is moving
- All passengers must wear seat belts, if provided
- No standing on rear platforms
- No exceeding manufacturer passenger limits
- Children may not operate golf carts
- Golf Carts may only be operated in designated Resort areas
- Resort speed limits must be obeyed at all times. (Resort speed limit is 15 m.p.h. or as posted)
- Pedestrians always have the right-of-way
- Headlights must be used after dark
- Operators must come to a complete stop at all stop signs
- Failure to come to a complete stop at stop signs constitutes reckless or unsafe driving
Violation of Resort rules may result in:
- Immediate termination of golf cart rental
- Confiscation of golf cart
- Removal from Resort property
- And/or additional charges
Responsibility for Minors and Guests
Renter accepts full responsibility for:
- All passengers
- Family members
- Invitees
- Minors
- And anyone using the golf cart under Renter’s reservation
Renter agrees that minors must be supervised at all times.
Damage Responsibility
Renter accepts responsibility for:
- Damage to the golf cart
- Damage to Resort property
- Damage caused by third parties
- Towing/recovery costs
- Lost equipment
- Cleaning charges
- Or excessive wear caused during rental period
Renter authorizes Resort to charge payment method on file for damages or violations.
Termination of Rental
Resort may immediately terminate rental without refund for:
- Unsafe operation
- Rule violations
- Intoxication
- Unauthorized drivers
- Reckless behavior
- Endangerment of guests or staff
Photo/Video Release
Renter consents to photography or video recording for:
- Security
- Safety documentation
- Marketing or promotional use
Release of Liability
To the fullest extent permitted under Florida law, Renter hereby releases, waives, discharges, and covenants not to due the Resort for any claims, demands, damages, causes of action, or liability arising out of or related to:
Renter is fully responsible for:
- Golf Cart operation
- Ridership
- Rental
- Maintenance
- Camping activities
- Or use of property
Including claims arising from negligence of the resort, except for gross negligence or intentional misconduct that cannot legally be waived under Florida law.
This release includes claims for:
- Personal injury
- Wrongful death
- Property Damage
- Economic loss
- And loss of enjoyment
Indemnification
Renter agrees to defend, indemnify, and hold harmless Resort from all claims, lawsuits, attorney’s fees, damages, liabilities, or expenses arising from:
- Renter’s Conduct
- Operation of the golf cart
- Acts of passengers
- Acts of minors
- Intoxicated operation
- Rule violations
- Or damage caused during rental
No Insurance Provided
Unless expressly stated in writing, Resort does not provide insurance coverage for:
- Injuries
- Collisions
- Theft
- Property damage
- Or liability associated with golf cart use
- Renter is encouraged to maintain personal insurance coverage
Florida Law/Venue
This agreement shall be governed by the laws of the State of Florida.
Any dispute or legal proceeding arising from this Agreement or Guest’s use of the Resort shall be brought exclusively in the courts located in Polk County, Florida.
Severability
If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.
Guest Acknowledgment
By completing the golf cart rental process, you acknowledge that you have reviewed and understand the terms of the Golf Cart Rental Agreement. You agree to follow all resort policies, accept responsibility for the safe operation of the golf cart, and confirm that you are authorized to accept the agreement on behalf of all members of your party.
